Apolo Art Gallery

This document establishes the Terms and Conditions governing access, navigation, and purchase of artworks through the Apolo Art Gallery website (hereinafter, the “Site”).
By accessing, browsing, or making a purchase on the Site, the user (hereinafter, the “Buyer”) expressly and unconditionally accepts these Terms and Conditions.
PLATFORM NATURE
Apolo Art Gallery acts exclusively as an intermediary between buyers and independent artists.
Apolo is not the author or owner of the artworks displayed, nor does it act as a direct seller, but rather as a platform for exhibition, commercialization, and payment management, facilitating the relationship between the Buyer and the artist.
BUYER DECLARATIONS
The Buyer declares that:
- They are of legal age and have the legal capacity to enter into contracts
- The information provided during the purchase process is truthful, complete, and up to date, especially contact and shipping details
- The purchase of an artwork is a personal and voluntary decision
- The Buyer is responsible for any consequences arising from incorrect or incomplete information provided by them
PURCHASE PROCESS
- All purchases are made 100% through the Site
- Prices are listed in Mexican Pesos (MXN)
- Once payment is confirmed, the Buyer will receive a confirmation email
- Shipping status will be notified once the artist has handed the artwork over to the carrier (DHL)
- The Buyer may cancel the purchase only before the artwork has been shipped
SHIPPING
- Shipping costs are covered by the Buyer, except in cases expressly stated in these Terms
- Estimated delivery time is 2 to 7 business days, which may vary due to logistical, environmental, or force majeure factors
Damage, loss, or delays
If the artwork arrives damaged, the Buyer may choose:
- A refund, or
- Restoration of the artwork
In these cases, the Buyer will not be required to cover additional shipping costs.
In case of total loss of the package, a full refund will be issued.
Apolo will act as a mediator in resolving incidents, without assuming additional liability.
RETURNS AND REFUNDS
Returns are accepted under the following circumstances:
- The artwork arrives damaged
- The artwork does not match what was published
- The Buyer is not satisfied with the artwork
Conditions:
- The Buyer has 7 calendar days from delivery to request a refund
- The Buyer must contact customer support to receive packaging and return instructions via DHL
- The refund will be processed 5 business days after the artwork has been returned to origin
- The refund will be issued via bank transfer
NATURE OF ART, CERTIFICATE OF AUTHENTICITY, AND DISCLAIMER
The Buyer acknowledges that:
- Artworks may be unique pieces or limited editions
- All artworks include a Certificate of Authenticity
The Certificate of Authenticity:
- Is issued in printed format
- Is shipped according to a predefined schedule
Certificate shipping schedule:
- Purchases made from the 1st to the 11th → shipped on the 15th of the same month
- Purchases made from the 12th to the end of the month → shipped on the 4th of the following month
The certificate is shipped separately from the artwork, and this process does not affect its validity, authenticity, or ownership.
Images of artworks are representative and may vary slightly due to lighting, photography, or screen differences, without digital alteration.
Apolo Art Gallery does not guarantee subjective interpretations, emotional value, symbolic meaning, or investment value of artworks, nor does it provide artistic, financial, or investment advice.
INTELLECTUAL PROPERTY OF ARTWORKS
The Buyer acquires only the physical artwork.
No reproduction, distribution, or commercial use rights are transferred.
Any commercial use requires explicit authorization from the artist.
SITE USE AND PROHIBITED CONDUCT
The Buyer agrees to use the Site lawfully. The following are prohibited:
- Fraudulent or improper use
- Mass content extraction
- Unauthorized resale
- Any action that affects the operation of the Site
Apolo reserves the right to cancel transactions or restrict access in case of suspicious or unlawful behavior.
TECHNICAL OR TYPOGRAPHICAL ERRORS
Apolo reserves the right to cancel orders resulting from obvious errors in pricing, availability, or description, issuing a full refund without additional liability.
PACKAGE REJECTION AND INCORRECT DATA
If the Buyer fails to receive, rejects, or provides incorrect shipping information, any resulting costs may be charged to the Buyer.
Apolo is not responsible for delays or losses caused by incorrect information provided by the Buyer.
ELECTRONIC COMMUNICATIONS
The Buyer agrees that:
- Email will be the official communication channel
- Notifications sent electronically have full legal validity
LIMITATION OF LIABILITY (GENERAL)
Apolo shall not be liable for indirect, incidental, or consequential damages.
Liability, if applicable, is limited to the amount paid for the artwork.
In cases of force majeure, Apolo is exempt from additional liability.
LIMITATION OF LIABILITY (OPERATIONAL)
Apolo Art Gallery assumes no responsibility for any consequences arising from user navigation, use, modification, or interpretation of information received through the Site or any communication channels.
Apolo is only responsible for irregularities when directly caused by proven negligence or technical failures attributable to the Site.
SITE INTELLECTUAL PROPERTY
All Site content (brand, texts, design, images, logos) is owned by Apolo Art Gallery or its rightful owners. Unauthorized use or reproduction is prohibited.
MODIFICATIONS
Apolo Art Gallery reserves the right to modify these Terms and Conditions at any time without prior notice. Changes take effect immediately upon publication.
SEVERABILITY
If any clause is deemed invalid, the remaining provisions remain in effect.
JURISDICTION AND APPLICABLE LAW
These Terms are governed by the laws of the United Mexican States.
Any dispute will be subject to the competent courts of Zapopan, Jalisco, Mexico.
PAYMENTS AND BILLING
- Payments are processed through Shopify Payments
- The Buyer authorizes charges to the selected payment method
- Transactions may be declined due to security checks, insufficient funds, or provider policies
- Apolo does not store or access financial data
Invoices (CFDI) may be requested within 24 hours after payment.

The Buyer may contact Apolo Art Gallery for any inquiries regarding purchases, Site information, or these Terms.
